Warranty

This warranty applies only if the equipment is used in accordance with the written operating instructions provided by Water Service Elite Inc. It does not apply if the equipment has been modified, repaired, or tampered with by unauthorized individuals, or if it has been subject to negligence or misuse. Labor warranties, if applicable, will be stated in the manufacturer’s warranty and this agreement.

TO THE EXTENT PERMITTED BY LAW, WATER SERVICE ELITE INC. DISCLAIMS ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. ANY IMPLIED WARRANTIES ARE LIMITED IN DURATION TO THE PERIODS AND PARTS SPECIFIED IN THE MANUFACTURER’S LIMITED WARRANTY AND THIS AGREEMENT.

YOUR SOLE REMEDY AGAINST WATER SERVICE ELITE INC. IS UNDER THE WARRANTY STATED ABOVE. THIS LIMITATION APPLIES TO REMEDIES ARISING OUT OF THIS AGREEMENT OR OTHERWISE IN CONNECTION WITH THE EQUIPMENT, MATERIALS, OR SERVICES PROVIDED BY WATER SERVICE ELITE INC. IN NO EVENT SHALL WATER SERVICE ELITE INC. BE LIABLE FOR DAMAGES OF ANY NATURE, INCLUDING BUT NOT
LIMITED TO DIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, GENERAL, OR OTHERWISE (INCLUDING PROPERTY DAMAGE) EXCEPT AS SPECIFICALLY STATED IN THIS AGREEMENT.

ANY ACTION RESULTING FROM THE DELIVERY OF GOODS OR SERVICES UNDER THIS AGREEMENT MUST BE COMMENCED WITHIN ONE YEAR AFTER THE CAUSE OF ACTION HAS ACCRUED. YOU ASSUME ALL LIABILITY FOR INJURY OR DAMAGE ARISING OUT OF THE POSSESSION, USE, OR CONTROL OF THE EQUIPMENT, INCLUDING PROPERTY
DAMAGE. YOU AGREE TO OBTAIN INSURANCE TO COVER ANY SUCH LIABILITIES.

Some states do not allow limitations on implied warranties or the exclusion or limitation of incidental or consequential damages, so these limitations may not apply to you. This warranty provides specific legal rights, and you may have other rights that vary by state.
Cancellation: Except as specified in the Notice of Cancellation, if you choose to cancel this order, you agree to pay any time and material charges incurred by Water Service Elite Inc.

You, the buyer, may cancel this transaction, without penalty or obligation, at any time prior to midnight of the third business day after the date of this transaction. If you cancel, any property
Traded in, any payments made by you under this order, and any negotiable instrument executed by you will be returned within 10 days (less time and material charges) following receipt by Water Service Elite Inc. Of your cancellation notice, and any security interest arising out of the transaction will be canceled. If you cancel, you must make available to the company at you Residence any goods delivered to you under this order, in substantially as good condition as when received. Alternatively, you may, at your discretion, comply with the instructions of the company regarding the return shipment of the goods at the seller’s expense and risk. Failure to make the goods available to the company will result in continued liability for all obligations under the order.
